Conservation Commission

The Essex Conservation Commission is responsible for administering the Wetlands Protection Act (G.L. Ch. 131 §40). Click here to see a copy of the Act. The Conservation Commission reviews applications for permits to do work in and near wetlands, flood plains, banks, riverfront areas, beaches and surface waters. At this time, Essex does not have any non-zoning bylaws or ordinances giving the Commission further power to protect the wetlands. Although the Commission does review plans which must be approved by other regulatory boards, the sole responsibility of the Commission is to determine if a project will have significant impact upon environmental resources and if it falls within the scope of the Wetlands Protection Act.

Eight Interests of the Massachusetts Wetlands Protection Act

1. Protection of public and private water supplies
2. Protection of groundwater supplies
3. Flood control
4. Storm damage prevention
5. Prevention of pollution
6. Protection of land containing shellfish
7. Protection of fisheries
8. Protection of wildlife habitat

If you are wondering if your project might require a filing, please click on the "Do I need to file?" question in our FAQ section. In Essex, it is required that most building permit applications for work being performed outside be reviewed by the Commission to determine if the project is covered under the Wetlands Protection Act. If you still need answers, please contact the Administrative Clerk or Agent by phone or email. Generally phone calls are returned within 24-48 hours and emails the same day.
