Minutes of the Zoning Board of Appeals

Members Present: Meg Nelson, Keith Carter, Mike Davis and Ed Perkins, Alternate.  

Members of the Public.

The meeting was called to order at 7:00 p.m.

Attorney Klasnick presented findings on Ms. Betsy Mills property at 32 Haskell Ct.  These finding reflected their position that this property will not be suitable for the applicant.  

Keith Vellante from C Squared Systems, LLC presented his findings based on the same height. He said if the parcel does not initially meet the requirements, then they do not continue with the process.  However, they did on this and each property would need relief from the ZBA.  It would cause greater impact even if they were able to use these properties due to the wetlands. They contacted Ms. Mills to no avail.  

Ms. Rutkowski, with TowerNorth Developments LLC, spoke and went through each parcel and determined each one either had wetlands, setback issues, needed to cross over streams or in one instance would need to relocate a trail.  She stated they tried to contact Ms. Mills and said they were finally told Ms. Mills would not be available until mid-September.  She reiterated they looked at these lots for the Zoning Board of Appeals but they do not meet the requirements for Verizon or the Applicant.

Chairperson Nelson opened the meeting up to the public for questions.  

Comments were Ms. Mills is in Maine and her property has not been given a fair shot.  

Atty Klasnick said the property does not meet Verizon’s needs and they did everything necessary to prove that.  

Chairperson Nelson asked Attorney Klasnick if the Applicant gave both identified properties equal consideration.   Attorney Klasnick said yes and wiling owners are needed.

Keith Carter made a motion to close the public hearing.  Mike Davis seconded with all in favor.  

Chairperson Nelson said the Board is not in a position to deliberate as they are waiting for a legal opinion from Town Counsel later in the month.  Then they will reconvene on October 4, 2021 at 7:00 p.m.

Keith Carter made a motion to approve the minutes of the August 4, 2021 meeting.  Mike Davis seconded with all in favor.

Keith Carter made a motion at 8:00 p.m. to adjourn the meeting.  Mike Davis seconded with all in favor.
